1. Agreement to Terms

By accessing or using ChamaPro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all users, including chama administrators, members, and visitors.

2. Description of Service

ChamaPro is a digital platform designed to help chamas (savings groups) manage their operations, including but not limited to:

  • Member management and registration
  • Contribution tracking and recording
  • Loan management and disbursement tracking
  • Meeting scheduling and minutes
  • Financial reporting and analytics
  • Payment processing via M-Pesa integration
  • Communication tools for chama members

3. User Accounts

3.1 Account Creation

To use ChamaPro, you must create an account by providing accurate, complete, and current information. You may register using email/password or through social login providers (Google, Facebook, Twitter).

3.2 Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your contact information remains accurate and up-to-date

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, illegal, or harmful activities.

4. User Roles and Permissions

ChamaPro supports different user roles with varying permissions:

  • Chairman: Full administrative access to chama operations
  • Treasurer: Financial management and reporting access
  • Secretary: Meeting and documentation management
  • Committee Member: Extended member privileges
  • Member: Basic access to view personal records and make contributions

5. Acceptable Use

You agree NOT to use ChamaPro to:

  • Violate any applicable laws or regulations
  • Engage in money laundering or fraudulent financial activities
  • Impersonate others or provide false information
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to other accounts
  • Upload malicious code, viruses, or harmful content
  • Harass, abuse, or harm other users
  • Use the Service for any illegal pyramid or Ponzi schemes

6. Financial Transactions

6.1 Payment Processing

ChamaPro facilitates payment processing through M-Pesa and other integrated payment providers. All financial transactions are subject to the terms and conditions of these payment providers.

6.2 Funds Handling

ChamaPro does not hold or manage chama funds directly. Payments are processed directly between members and the chama's designated payment channels (paybill numbers, bank accounts). We are not responsible for the management or safekeeping of chama funds.

6.3 Transaction Records

We provide transaction recording and reporting tools, but chamas are responsible for verifying the accuracy of their financial records and maintaining proper accounting practices.

7. Subscription and Fees

ChamaPro offers various subscription plans with different features and pricing:

  • Free Plan: Basic features for small chamas
  • Premium Plans: Advanced features, higher member limits, and priority support

Subscription fees are non-refundable unless otherwise specified. We reserve the right to modify pricing with reasonable notice to users.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by ChamaPro and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit to the Service, but grant us a license to use, store, and display such content as necessary to provide the Service.

9. Privacy

Your use of ChamaPro is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Disclaimers

10.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free operation of the Service.

10.2 Financial Advice

ChamaPro is a management tool and does not provide financial, legal, or investment advice. Chamas should consult appropriate professionals for such guidance.

10.3 Third-Party Services

We are not responsible for the availability, accuracy, or content of third-party services integrated with ChamaPro, including payment providers and social login services.

11. Limitation of Liability

To the maximum extent permitted by law, ChamaPro and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount paid by you, if any, for the Service during the twelve months prior to the claim.

12. Indemnification

You agree to indemnify and hold harmless ChamaPro, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Kenya.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
